1. Scope
These Terms of Use govern the use of drumary.app (the "Service"), operated by Maximilian Zumbansen, Fehmarner Str. 7, 13353 Berlin, Germany (the "Provider"). By creating an account or using the Service, you agree to these Terms.
The Service is provided free of charge.
2. Registration and account
Use of the Service requires a user account. You must provide accurate information during registration and keep it up to date. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us immediately at info[at]drumary.app if you suspect unauthorized use of your account.
There is no entitlement to registration or use of the Service. We may refuse registration without giving reasons.
3. Acceptable use
You agree not to:
- use the Service for any unlawful purpose;
- attempt to gain unauthorized access to the Service, other user accounts, or the underlying infrastructure;
- interfere with or disrupt the operation of the Service (e.g. through automated mass requests, scraping, or the introduction of malicious code);
- share your account with third parties.
4. Availability
The Service is provided free of charge and without any guarantee of availability, freedom from errors, or fitness for a particular purpose. We may modify, restrict, suspend, or discontinue the Service, in whole or in part, at any time. Where reasonably possible, we will announce a discontinuation in advance so you can contact us at info[at]drumary.app to request a copy of your data before it is deleted.
5. Liability
The Provider is liable without limitation for intent and gross negligence, as well as for damages resulting from injury to life, body, or health, and under the German Product Liability Act (Produkthaftungsgesetz).
In cases of slight negligence, the Provider is liable only for the breach of essential contractual obligations (obligations whose fulfilment is a prerequisite for the proper performance of the contract and on whose fulfilment you may regularly rely), and in such cases liability is limited to the foreseeable damage typical for this type of contract.
Any further liability is excluded.
6. Termination
You may stop using the Service and delete your account at any time by emailing us at info[at]drumary.app. We may terminate or suspend your account with reasonable notice, or without notice for good cause (in particular, a violation of these Terms). Upon termination, your account data will be deleted in accordance with our Privacy Policy.
7. Changes to these Terms
We may amend these Terms for the future where this is necessary for valid reasons (e.g. changes in the law, changes to the functionality of the Service) and the changes are reasonable for you. We will notify you of changes in an appropriate manner (e.g. by email or a notice within the Service) at least four weeks before they take effect. If you do not object within this period or continue to use the Service after the changes take effect, the amended Terms are deemed accepted; we will point this out in the notification.
8. Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of your country of habitual residence.
Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions remains unaffected.
